PRIVACY POLICY

Fitzroy Publishing Pty Ltd recognise the importance of protecting the privacy of personally identifiable information collected about our customers. For the purposes of this Privacy Statement, the word customers includes visitors to our web sites, subscribers to and users of our services, purchasers of our products and advertising customers.

We are bound by the National Privacy Principles in the Privacy Act 1988 (Cth) in relation to the handling of personal information. Where appropriate we will handle personal information relying on the media exemption (but complying with the Australian Press Council Privacy Standards), related bodies corporate exemption and the employee exemption in the Privacy Act.

Personal Information

We collect personal information when we provide our services to you. Generally we will tell you why we are collecting information when we collect it and how we plan to use it or these things will be obvious when we collect the information. We usually collect personal information directly from you although sometimes we may use agents or service providers to do this for us. We may also acquire lists from other sources, both from other companies and from other public documents. We may automatically collect personal information by collecting and tracking the unique device identifier or the universally unique identifier of the devices you use to access our services.

If you access or log-in to one of our services through a third party social media service or connect your use of our service to a third party social media service, the information we collect may also include your user ID and/or user name associated with that social media service, any information or content you have permitted the third party social media service to share with us, such as your profile picture, email address or friends lists, and any information you have disclosed in connection with that social media service. We do not collect your passwords other than in relation to our own services. When you access our services through third party social media services or when you connect your use of our service to third party social media services, you are authorizing us to collect, store, and use such information and content in accordance with this Privacy Policy.

Use of Information

We usually collect personal information such as your name, address, telephone number, and in some instances, your financial details. When you are online, we collect information regarding the pages within our network which you visit and what you click on. As a general rule we do not collect sensitive information. However, if we do, it will usually be for the purposes of providing our goods or services and if the law requires us to, we will seek your consent to collect it.

We use your information to provide our services (which on digital platforms may include the display of personalised content and advertising) to you, to fulfil administrative functions associated with these services, for example billing, credit and account management, to enter into contracts with you or third parties and for marketing and client relationship purposes. Where your personal information is contained within an advertisement which we publish for you, we may also use your information for publication of that same advertisement in other media, in accordance with the terms and conditions of the initial publication. Where your personal information is contained in a user generated post or in a communication to an editor or journalist, we may publish your name and suburb to identify you as the author of the comment/correspondence if we choose to publish your comment/correspondence in any media.

We may share your information with other companies which are related to Fitzroy Publishing Pty Ltd  within or outside of Australia. We or they may also, in addition to the other uses described in this policy or as permitted at law, use your personally identifiable information to assist us in improving our products and services and any of us might be in touch to let you know about goods, services, or promotions which may interest you.

If you log in with or connect a social media service account with any of our services, we may share your user name, picture, and likes, as well as your comments with other users of our services and with your friends associated with your social media service. We may also share the same information with the social media service provider. By logging in with or connecting your account for any of our services with a social media service, you are authorizing us to share information we collect from and about you with the social media service provider, other users and your friends and you understand that the social media service’s use of the shared information will be governed by the social media service’s privacy policy. If you do not want your personal information shared in this way, please do not connect your social media service account with your account for any of our services and do not participate in social sharing on any of our services.

We may disclose your personal information in order to comply with Australian or foreign law.

Use by Third Parties

Fitzroy Publishing Pty Ltd may disclose your information to its service providers (including technical infrastructure providers) and contractors (including mail houses or debt collection agencies) from time to time but only to help us to provide, improve and market our goods and services. We may also share your information with third parties who provide prizes for competitions or reader offers. If we do any of these, we generally require the third parties to protect your information at least to the same degree that we do. If you have consented to us doing so, Fitzroy Publishing Pty Ltd  may also share your information with a third party for the purpose of enabling those third parties to contact you with marketing messages.

Use of Aggregate Data

We may collect and use certain non-personal information (e.g., the identity of your Internet browser, the type of operating system you use, your IP address and the domain name of your Internet service provider) to optimise our goods and services (which on digital platforms may include the display of personalised content and advertising) including our Web pages for your computer. We may use such non-personal information for internal purposes, including but not limited to improving the content of our sites.

Fitzroy Publishing Pty Ltd may use personally identifiable information in aggregate form to improve our goods and services including our Web sites and make them more responsive to the needs of our customers. This statistical compilation and analysis of information may also be used by Fitzroy Publishing Pty Ltd  or provided to others as a summary report for marketing, advertising or research purposes.

Security

Fitzroy Publishing Pty Ltd  strives to ensure the security, integrity and privacy of personally identifiable information of our customers. We use a variety of physical and electronic security measures including restricting physical access to our offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure.

Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure.

Access to Personal Information

You have a right to access most personal information we hold about you and if we deny access in some circumstances we will tell you why. To request access, please contact us through any of the means provided on our contacts page.

Public Information

Any information posted on bulletin boards and/or communicated in chat areas becomes public information. While Fitzroy Publishing Pty Ltd  strives to protect and respect your privacy, we cannot guarantee the security of any information you disclose in a chat room or bulletin board.

Cookies

Cookies are data that a Web site transfers to an individual’s hard drive for record-keeping purposes. Cookies can facilitate a user’s ongoing access to and use of a site. They allow us to track usage patterns and to compile data that can help us improve our content and target advertising. If you do not want information collected through the use of Cookies, there is a simple procedure in most browsers that allows you to deny or accept the Cookie feature. But you should note that Cookies may be necessary to provide you with features such as merchandise transactions or registered services.

Fitzroy Publishing Pty Ltd  may establish relationships with business partners that allow visitors to our Internet sites to link directly to sites operated by these partners. Some of these sites may be “co-branded” with our logo; however, these sites may not be operated or maintained by or on our behalf. These sites may collect personal information from you that may be shared with us. This Privacy Statement will apply to any personal information we obtain in this manner.

Fitzroy Publishing Pty Ltd  is not responsible for the content or practices of Web sites operated by third parties that are linked to our sites. These links are meant for the user’s convenience only. Links to third party sites do not constitute sponsorship, endorsement or approval by Fitzroy Publishing Pty Ltd  of the content, policies or practices of those third party sites. Once you have left our site via such a link, you should check the applicable privacy policy of the third party site.

What else you should know about privacy on the internet

Remember to close your browser when you have finished your user session. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet café. You as an individual are responsible for the security of and access to your own computer.

Whenever you voluntarily disclose personal information over the Internet that this information can be collected and used by others. In short, if you post personal information in publicly accessible online forums, you may receive unsolicited messages from other parties in return. Ultimately, you are solely responsible for maintaining the secrecy of your username and passwords and any account information. Please be careful and responsible whenever you are using the internet.

We may amend our privacy policy from time to time and personal information held by us will be governed by the most recently stated policy. We will post all changes on this page so you should revisit this page from time to time to see any changes. The date of the last update will inform you as to whether there have been changes since your last visit.

TERMS & CONDITIONS

In these terms and conditions Fitzroy Publishing Pty  Limited will be referred to as FP .

These Terms and Conditions apply to the following types of subscriptions: The Shift Miner 12 Month Plan Digital Subscription and The Shift Miner fully flexible weekly Digital Subscription.

You must have a valid and current Registered Access to have a valid subscription.

FP may change any applicable terms and conditions from time to time. If this happens, amendments will be posted on the affected Sites or other FP Digital Media and will also be accessible through your login to My Account. If you object to changes to any terms or conditions you may cancel your Subscription up to 28 days after the changes come into effect without accepting the new terms and conditions. If you do not cancel or you use or access any FP sites or FP Digital Media (other than to review the new terms and conditions) using your Subscription within that period you will be deemed to have accepted the new terms. You may call 0428254653 if you have reasonable grounds for not having cancelled within the 28 day time limit and still wish to cancel.

Digital Membership Terms and Conditions

Digital Membership provides you access via a secure login to view unlimited content at Shift Miner

The above may change from time to time, at our discretion. FP will endeavour to contact you at least 14 days prior to effecting the removal of any media from these lists. Your Digital Membership will commence immediately on receipt by us of completed subscription details, including payment details. Confirmation of acceptance will be provided to you via your nominated email address.

Each username and password is assigned to a single user. You must ensure that your username and password remain secure and are only shared with the residents of your household i.e. family and friends that live at the same residential address. However you agree that your Digital Membership cannot be used with more than four devices concurrently. You are responsible for all use, activities and charges associated with your username and password. Your username and password are not otherwise transferable.

Your Digital Membership may be used for non-commercial purposes only.

Access from outside of Australia

You acknowledge that some of our content may not be viewable or accessible from outside of Australia.

Pricing

The price of the subscription, including where applicable any introductory pricing for a specified period will be displayed at the time of purchase. All prices include GST unless otherwise specified.

FP may amend the pricing schedule with prior notice to you. Once new pricing takes effect FP may alter your automatic payment arrangements accordingly.

Where your Subscription is for a specified plan period or a fixed term with regular, periodic payments (with or without a further term on the same or different terms) then the total price that you will pay is the total sum of all regular periodic payments throughout the specified plan period or fixed term (plus the relevant price for any relevant further terms prior to cancellation being affected). FP will not change the pricing for a plan period or fixed term subscription during that fixed term.

Information about your current Subscription, including its price is available in My Account under Manage My Subscriptions.

Payment, Fees and Taxes

Subsequent to any non-refundable introductory period, payment is to be made by automatic recurring weekly payments via PayPal (when available as specified by FP when the offer is made) or debit/credit cards. Payments are made in advance..

If payment fails, we will attempt to notify you and request that you update your payment details. We will re-attempt payment several times. During this period we may grace your subscription for up to 7 days after which time we will commence the cancellation process.

For the purpose of auto-renewing your Subscription, your PayPal or credit card details are stored in a tokenised, encrypted format. They are therefore available should you elect to purchase another subscription.

Through this sales platform you can only sign up for yourself. You cannot sign up as a gift for another person.

Cancellation, Termination and Refunds Policy

Your Subscription will continue until cancelled by either one of us. You may cancel your Subscription by logging and clicking subscription under the drop down tab under your name.Cancellations will take effect at the end of the subscription period, which is current at the end of the 7 business day notice period.

The following applies regarding refunds.

1. If your Subscription requires you to pay:

  1. Subscription fees in advance every week
  2. Subscription fees in advance annually

then those prepaid fees are not refundable, in whole or in part, unless:

  1. FP cancels your subscription, other than due to a breach of our terms and conditions;
  2. Required by law

2. If your subscription is for a fixed term with regular periodic payments throughout the term then you may not cancel your subscription prior to the expiry of the specified fixed term (so for example, where your subscription requires a payment every 4 weeks for 52 weeks then you may not cancel your subscription to take effect before the expiry of the first 52 weeks).

These guidelines provide a detailed framework for the production of our news and other content. They provide guidance as to the processes we have in place to ensure the quality, accuracy and legality of all content produced by Fitzroy Publishing Pty Ltd (FP). For guidance on complaint handling, please go to the section at the end of the document titled accordingly.

  1. Independence, Integrity, responsibility

In all situations, the content generated by FP across all our platforms recognises the influence and responsibility we have in shaping public opinion. Where content is sponsored, supported or externally influenced beyond the normal pressures of the journalistic process, this will be clearly displayed and in a format unable to be confused with our own independent journalism.

  1. Accuracy

The FP accuracy standard applies to assertions of fact, not to expressions of opinion. An opinion, being a value judgement or conclusion, cannot be found to be accurate or inaccurate in the way facts can. The accuracy standard requires that opinions be conveyed accurately, in the sense that quotes should be accurate and any editing should not distort the meaning of the opinion expressed.

While the journalistic process requires us to make decisions on what type of information sources have the greatest bearing on our content, we will take all reasonable steps to ensure all facts are validated, and all alternative explanations of events considered. Our flat editorial structure means senior editorial oversight is coded into the publishing process always. Where new information comes to light that renders previous information redundant we will amend and/or clarify any ambiguity or inaccuracy.

  1. Fair Impartial and honest dealing

We acknowledge that the journalistic process has within it, inevitable biases expressed either knowingly or unknowingly by the journalist. To combat this we have a process in place that demands fair, considered and honest dealing with regard to all aspects of disputed news and events. As a publisher, we are not partial to any version of the world relevant to our readers, other than the one we conclude from fair honest and diligent journalistic dealings

  1. Rating, Harm and offence

FP publishes comprehensive and innovative content that aims to inform, entertain and educate diverse audiences. Innovation involves a willingness to take risks, invent and experiment with new ideas. This can result in challenging content which may offend some of the audience some of the time. Where content has the capacity to offend or harm members of our audience, we will take all reasonable steps to provide a warning beforehand. Content for our digital platforms is not rated appropriate for people under 13.

  1. Complaint Handling Process

As discussed in sections 1, 2 and 3 of the editorial policies, FP has processes in place to ensure that all content is accurate, fair and balanced. However, from time to time we accept that there will be complaints (either justified or unjustified) about our content.

In all situations, we encourage the public to lodge complaints, so that we may review our content for accuracy or for failure to reach the standards we have set for ourselves. 

However, it should be remembered that not all complaints will result in remedial action by FP.

Below outlines the acceptable channels for lodging complaints.

Management is happy to discuss editorial decisions on the phone in a civil and robust manner. However, phoned complaints will be classified as informal and an extension of the existing journalistic processes.

All written complaints are treated as formal by Management and will trigger the following responses.
